    Terms of Service

    Welcome to TruthTides ("TruthTides," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the websites located at truth-tides.com, truthtides.com, and any subdomains, the TruthSource reference tool, the Evidence Library, the Physician Directory, the Blog, and any related products or services (collectively, the "Services"). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.

    1. Not Medical Advice

    TruthTides is an educational and bibliographic reference platform. It is not a medical provider, pharmacy, telehealth service, diagnostic tool, or substitute for professional medical care. The Services summarize publicly available scientific literature; they do not diagnose, treat, cure, mitigate, or prevent any disease, and they do not provide individualized medical, pharmacological, nutritional, fitness, or psychological advice. Nothing on the Services constitutes the practice of medicine, pharmacy, or any other licensed profession.

    You should not act or refrain from acting on the basis of anything you read on the Services without first consulting a qualified, licensed healthcare professional who has reviewed your specific situation. Reliance on any information provided by the Services is solely at your own risk. If you believe you are experiencing a medical emergency, call 911 (or your local emergency number) immediately.

    2. No Doctor-Patient or Pharmacist-Patient Relationship

    Use of the Services, including the TruthSource AI reference tool and the Physician Directory, does not create a doctor-patient, pharmacist-patient, or any other professional-client relationship between you and TruthTides, its personnel, or any physician listed in the directory. Physicians listed in the directory are independent third parties; their listing is not an endorsement, recommendation, or referral. TruthTides does not vouch for the competence, qualifications, or conduct of any listed physician.

    3. Eligibility

    You must be at least 18 years old and capable of forming a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that your use does not violate any law applicable to you.

    4. Accounts

    Some features (including physician listings, the physician dashboard, and certain reference tool usage tiers) require an account. You agree to (a) provide accurate, current, and complete information; (b) maintain the security of your credentials; (c) promptly notify us of any unauthorized use; and (d) accept responsibility for all activity under your account. We may suspend or terminate accounts that violate these Terms, that we reasonably believe are fraudulent, or that pose a risk to the Services or other users.

    5. Physician Listings and Subscriptions

    Physicians who wish to claim a directory listing must verify their identity against the National Plan and Provider Enumeration System (NPPES / NPI registry) and may be required to provide additional credentialing documentation. Listings are sold as flat-rate subscriptions, not as per-referral or per-patient fees. TruthTides does not broker referrals, does not receive compensation contingent on patient volume, and does not participate in any arrangement that would constitute a referral fee under federal or state law.

    Subscription billing is handled by Stripe. By subscribing, you authorize recurring charges until you cancel through the customer portal. Cancellations take effect at the end of the current billing period; fees already paid are non-refundable except where required by law.

    6. The TruthSource AI Reference Tool

    The TruthSource AI tool is a source-locked, citation-anchored interface to a curated database of published research. The model is constrained, by design, to answer only from the database. It is intended to summarize what the literature says — not to recommend, prescribe, dose, diagnose, or treat. The tool will redirect clinical questions (such as dosing, combinations, and "is this safe with my medication") to a licensed prescriber.

    You acknowledge that AI systems may produce errors, omissions, or out-of-date information, and that you will not rely on the tool's output as medical advice or a substitute for clinical judgment. You agree not to (a) attempt to bypass, jailbreak, or otherwise manipulate the model's safety constraints; (b) use the tool to make individualized clinical or treatment decisions for any patient; or (c) hold TruthTides liable for any health, financial, or other consequence arising from your use of the tool's output.

    7. Acceptable Use

    You agree not to:

    • Use the Services in violation of any applicable law, regulation, or third-party right.
    • Scrape, harvest, or copy any portion of the Services other than as expressly permitted.
    • Reverse engineer, decompile, or attempt to derive the source code of the Services.
    • Interfere with or disrupt the integrity, security, or performance of the Services.
    • Probe, scan, or test the vulnerability of the Services without prior written permission.
    • Submit content that is false, misleading, infringing, defamatory, harassing, or unlawful.
    • Impersonate any person or entity or misrepresent your affiliation.
    • Use the Services to develop a competing product, train a competing AI model, or otherwise build a substantially similar service.
    • Use the Services to make individualized medical, prescribing, or diagnostic decisions about any specific patient.

    We may investigate and take action against any violation, including suspension, termination, removal of content, and referral to law enforcement.

    8. Intellectual Property

    All content on the Services — including text, summaries, evidence grades, code, design, the TruthTides and TruthSource marks, logos, and the underlying compilation of literature — is owned by TruthTides or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial educational use, or, for physicians and enterprise subscribers, for the internal-reference purposes contemplated by your subscription. No other rights are granted.

    You retain ownership of content you submit (for example, contact form messages or lead capture submissions). By submitting it, you grant TruthTides a worldwide, royalty-free, sublicensable, irrevocable license to use, store, reproduce, and process that content for the purpose of operating, improving, and supporting the Services.

    9. Third-Party Content and Links

    The Services may reference or link to third-party sources, including PubMed, ClinicalTrials.gov, FDA databases, NPPES, and third-party websites. We are not responsible for, and do not endorse, third-party content. Your use of third-party services is governed by their own terms.

    10. Privacy

    Your use of the Services is also governed by our Privacy Policy, which is incorporated by reference. TruthTides is not a "Covered Entity" or "Business Associate" under HIPAA and does not knowingly collect Protected Health Information.

    11. Disclaimers

    THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, TruthTides disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, completeness, currency, and uninterrupted operation.

    WITHOUT LIMITING THE FOREGOING, TRUTHTIDES MAKES NO REPRESENTATION OR WARRANTY THAT THE SERVICES, OR ANY INFORMATION OBTAINED THROUGH THE SERVICES (INCLUDING TRUTHSOURCE AI OUTPUTS, EVIDENCE GRADES, OR THE PHYSICIAN DIRECTORY), IS ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR ANY MEDICAL, CLINICAL, OR INDIVIDUAL USE. Some jurisdictions do not allow the disclaimer of implied warranties; in those jurisdictions, the foregoing disclaimers apply to the maximum extent permitted by law.

    12. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TRUTHTIDES, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT TRUTHTIDES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    TRUTHTIDES' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TRUTHTIDES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).

    The limitations in this Section 12 apply to the maximum extent permitted by applicable law, even if a remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the smallest extent permitted by law.

    13. Indemnification

    You agree to defend, indemnify, and hold harmless TruthTides and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any clinical or treatment decision you make in connection with information obtained from the Services.

    14. Modifications to the Services and Terms

    We may modify the Services at any time without notice. We may also modify these Terms; if we do, we will post the updated Terms and, for material changes, take reasonable steps to notify you. Your continued use of the Services after an update constitutes acceptance.

    15. Termination

    You may stop using the Services at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including 1, 2, 7–13, and 16–18) will survive.

    16. Governing Law and Dispute Resolution

    These Terms are governed by the laws of the state in which TruthTides maintains its principal place of business, without regard to its conflict-of-laws rules. Subject to Section 17, the state and federal courts located in that state will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Services, and the parties consent to personal jurisdiction and venue there.

    17. Arbitration and Class Action Waiver

    Please read this section carefully — it may affect your legal rights.

    Any dispute arising out of or related to these Terms or the Services that cannot be resolved informally within sixty (60) days will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted remotely or in the state in which TruthTides maintains its principal place of business, unless you and TruthTides agree otherwise. Judgment on the award may be entered in any court of competent jurisdiction.

    You and TruthTides each waive any right to a jury trial and any right to participate in a class, collective, or representative action. Either party may bring an individual action in small-claims court instead of arbitration if the claim qualifies.

    18. Miscellaneous

    These Terms are the entire agreement between you and TruthTides regarding the Services and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.
